1. Services Overview
Benefit Whiz provides software tools designed to help insurance brokerages, agencies, consultants, and related businesses track, organize, reconcile, analyze, forecast, and allocate commission-related revenue and payment information.
The Services may include features for uploading commission statements, tracking expected versus received commissions, identifying missing or underpaid commissions, supporting payout calculations, forecasting revenue, and producing reports and analytics.
The Services do not replace your carrier systems, accounting systems, payroll systems, legal advisors, or financial professionals.
2. Eligibility and Business Use
You may use the Services only if you are at least 18 years old, have authority to enter into these Terms, are using the Services for lawful business purposes, and comply with all applicable laws. The Services are not intended for personal or consumer use.
3. Accounts and Authorized Users
You are responsible for providing accurate account information, keeping credentials confidential, ensuring only authorized individuals access your account, and all activity occurring under your account. Notify Benefit Whiz promptly of any unauthorized access or suspected security issue.
4. Customer Data
4.1 Customer Ownership
As between you and Benefit Whiz, you retain all right, title, and interest in your Customer Data. Benefit Whiz does not claim ownership of your Customer Data.
4.2 Limited License
You grant Benefit Whiz a limited license to access, process, and store Customer Data solely as necessary to provide the Services, troubleshoot issues, and comply with applicable law.
4.3 Data Use Restrictions
Benefit Whiz will not sell your Customer Data, use it to compete with you, or use identifiable Customer Data to train generalized AI models without your consent.
5. Financial Data and Commission Disclaimer
Benefit Whiz provides tools to assist with commission tracking and reconciliation. However:
- Benefit Whiz does not guarantee the accuracy or completeness of any commission, payout, or calculation
- Carrier statements may be incomplete, delayed, or inaccurate
- The Services are intended to support review and decision-making, not replace human judgment
You are solely responsible for reviewing all outputs, confirming amounts owed or received, and making all accounting and business decisions. Benefit Whiz is not responsible for lost commissions, incorrect payouts, or business losses arising from your use of the Services.
6. AI-Assisted Features
The Services may include AI-assisted features. AI-generated outputs are not guaranteed to be accurate or appropriate for your circumstances. You are responsible for independently reviewing and validating AI-generated outputs before relying on them.
7. Security
Benefit Whiz implements commercially reasonable safeguards including encryption in transit, access controls, authentication, logging, and secure hosting. No system is completely secure. You are responsible for maintaining appropriate security controls on your own systems.
8. Acceptable Use
You agree not to use the Services for unlawful purposes, upload malicious code, interfere with the Services, attempt unauthorized access, reverse engineer the Services, or upload data you do not have the right to use.
9. Subscription, Fees, and Payment
If you purchase paid Services, fees are due in U.S. dollars, are non-refundable, and recur until canceled unless otherwise stated. Late or failed payment may result in suspension of access.
10. Intellectual Property
Benefit Whiz and its licensors own all right, title, and interest in the Services including software, interfaces, designs, analytics, and documentation. Except for the limited right to use the Services, no rights are granted to you.
11. Limitation of Liability
To the maximum extent permitted by law, Benefit Whiz shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost commissions, or business losses arising from your use of the Services.
12. Governing Law
These Terms are governed by the laws of the applicable jurisdiction without regard to conflict of law principles.
13. Changes to These Terms
Benefit Whiz may update these Terms from time to time. Material changes will be communicated via the platform or email. Continued use of the Services after changes take effect constitutes acceptance.
